The agreement for using PulsePanda

1. Acceptance of Terms

By creating an account, accessing PulsePanda, or using our services, you agree to these Terms and Conditions. If you use PulsePanda on behalf of a company or other organization, you represent that you have authority to bind that organization.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use PulsePanda. If you register for a company, agency, or other organization, you represent that you are authorized to create and manage the workspace on its behalf.

3. Accounts and Workspaces

You are responsible for maintaining accurate account information, protecting login credentials, and managing access to your workspace. You are responsible for activity that occurs under your account or workspace.

You must promptly update account details when ownership, billing contacts, workspace administrators, or security contacts change.

4. Account Security

You are responsible for keeping your devices, sessions, API keys, SDK keys, passwords, and connected third-party accounts secure. You must notify us promptly if you suspect unauthorized access, credential compromise, or misuse of your workspace.

We are not responsible for losses caused by your failure to secure your account, devices, network, browser, integrations, or credentials.

5. Use of the Service

You may use PulsePanda only in accordance with these terms, applicable laws, and product documentation. You must not misuse the service or interfere with its operation.

• Do not attempt to bypass security, rate limits, or access controls.
• Do not upload or collect data you are not legally permitted to process.
• Do not use PulsePanda to monitor websites, apps, or users without appropriate notice and consent.
• Do not reverse engineer, resell, or provide unauthorized access to the service.
• Do not use bots, scrapers, crawlers, or automated systems to extract service data except through documented APIs and permitted integrations.
• Do not upload malware, attempt denial-of-service attacks, or introduce code that disrupts the service or another customer's systems.

6. Customer Data and Content

You retain ownership of data, content, events, recordings, forms, feedback, and configurations you send to PulsePanda. You grant us the rights needed to host, process, transmit, and display Customer Data to provide, secure, support, and improve the service.

You are responsible for your Customer Data and for ensuring your use of PulsePanda complies with privacy, security, employment, and data protection laws.

You must not submit content that infringes another party's rights, is unlawful, harmful, deceptive, abusive, obscene, discriminatory, or otherwise violates applicable law or these terms.

7. SDKs, APIs, and Integrations

PulsePanda may provide SDKs, APIs, webhooks, scripts, and third-party integrations. You are responsible for implementing them correctly, disclosing tracking where required, and configuring access controls, domains, consent flows, and data collection settings.

You must not use undocumented endpoints, overload our infrastructure, remove attribution or notices where required, or use integrations in a way that violates a third party's terms.

8. Data Security and Internet Risks

We use reasonable technical and organizational measures designed to protect the service. However, internet-based services, browsers, devices, scripts, and third-party networks are not risk-free. You acknowledge that data transmission and storage may involve security risks outside our control.

9. Privacy

Our handling of personal information is described in the Privacy Policy. Your use of PulsePanda is also subject to that policy.

10. Plans, Billing, and Taxes

Paid plans are billed according to the pricing, billing cycle, and limits presented at checkout or in an applicable order form. You authorize us and our payment processors to charge applicable fees and taxes.

Unless otherwise stated, fees are non-refundable except where required by law. You are responsible for taxes, duties, and similar charges related to your purchase.

11. Trials, Changes, and Suspension

Trial access may be limited or ended at any time. We may suspend or restrict access if payment is overdue, usage creates security or operational risk, or we reasonably believe the service is being misused.

12. Intellectual Property

PulsePanda, including its software, design, branding, documentation, and underlying technology, is owned by PulsePanda or its licensors. These terms do not transfer ownership of our intellectual property to you.

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use PulsePanda for your internal business purposes.

13. Third-Party Services and Links

PulsePanda may integrate with or link to third-party services, websites, processors, identity providers, analytics tools, hosting providers, and payment platforms. Your use of those services may be governed by separate terms and privacy policies. We are not responsible for third-party products outside our control.

14. Confidentiality

If either party receives non-public information from the other that is identified as confidential or should reasonably be understood as confidential, the receiving party must use reasonable care to protect it and use it only for purposes related to the service. Confidential information does not include information that is public, independently developed, or lawfully obtained from another source.

15. Communications

We may send service, security, billing, legal, and administrative notices to the email addresses or product inboxes associated with your account. You may opt out of marketing messages, but you may continue to receive transactional and service-related communications.

16. Disclaimers

PulsePanda is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Product analytics, recordings, event data, feedback, reports, and automated insights are provided for informational and operational purposes. You are responsible for independently verifying decisions made using the service.

17. Limitation of Liability

To the fullest extent permitted by law, PulsePanda will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, or data.

18. Indemnity

You agree to defend, indemnify, and hold PulsePanda harmless from claims, damages, liabilities, losses, costs, and expenses arising from your Customer Data, your use of the service, your breach of these terms, your violation of law, your integrations, or your infringement of another party's rights.

19. Termination

You may stop using PulsePanda at any time. We may terminate or suspend access if you breach these terms, fail to pay fees, provide inaccurate account information, or create legal, security, fraud, abuse, or operational risk. Sections that by nature should survive termination will continue to apply.

20. Relationship of the Parties

These terms do not create a partnership, joint venture, employment, agency, fiduciary, or franchise relationship between you and PulsePanda. Neither party may bind the other without written authority.

21. Governing Law and Disputes

These terms are governed by the laws applicable to PulsePanda's place of business, without regard to conflict-of-law rules. Courts with jurisdiction over that place of business will have exclusive jurisdiction unless applicable law requires another forum.

22. Severability

If any part of these terms is found invalid or unenforceable, the remaining provisions will continue in effect. The invalid or unenforceable provision will be interpreted or replaced to most closely reflect the original intent while remaining enforceable.

23. Changes to These Terms

We may update these terms from time to time. If changes are material, we will provide notice through the product, website, or another appropriate channel. Continued use after changes take effect means you accept the updated terms.
